These Terms of Service govern your use of our websites, including e2erisk.com. Use of the E2ERisk platform under a signed agreement is governed by your separate customer contract.

Please read these Terms carefully before using our websites. By accessing or using e2erisk.com, e2esc.co.uk or any associated E2E SC website (collectively, the "Websites"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our Websites.

1. About these terms

These Terms of Service ("Terms") govern your use of the websites operated by E2E Security Consulting Ltd ("E2E SC", "we", "us" or "our"), including e2erisk.com, e2esc.co.uk and any other website to which these Terms are linked from the footer or a /terms page (collectively, the "Websites").

These Terms apply to all visitors, users and others who access or use the Websites ("you" or "users"). Use of any E2E SC service under a signed agreement is additionally governed by the relevant Master Services Agreement, Order Form and our Acceptable Use Policy. We recommend you check this page periodically; the date above shows when these Terms were last updated.

3. Use of our websites

3.1 Permitted use

You may use our Websites for lawful purposes only. Permitted uses include browsing our services, reading published content, submitting enquiries and accessing resources we make publicly available. You must be at least 18 years of age (or the age of majority in your jurisdiction) to use our Websites.

3.2 Access and availability

We do not guarantee that our Websites will be available at all times, or that access will be uninterrupted, timely, secure or error-free. We reserve the right to withdraw, suspend or restrict access to all or any part of our Websites at any time without notice.

3.3 Account registration

Where we offer account registration, trial access or gated content, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at security@e2esc.co.uk if you suspect any unauthorised use of your account.

4. Acceptable use

The following acceptable-use rules apply to your use of our Websites. A fuller Acceptable Use Policy governs use of our paid services and is available on request.

You must not:

  • use our Websites for any unlawful purpose or in any way that violates applicable local, national or international law or regulation;
  • transmit any unsolicited or unauthorised advertising or promotional material (spam);
  • knowingly transmit any malware, viruses, trojans, worms, spyware, adware or other harmful or malicious code;
  • conduct or facilitate any security testing, scanning, probing or enumeration of our Websites or infrastructure without our prior written consent;
  • attempt to gain unauthorised access to any part of our Websites, servers, databases or systems connected to our Websites;
  • circumvent, disable or interfere with security features of our Websites, including any rate limiting, authentication or access control mechanism;
  • use any robot, spider, scraper, crawler or other automated means to access our Websites without our prior written permission, except for legitimate search engine indexing;
  • harvest, collect or compile personal data from our Websites without consent;
  • impersonate any person or entity, or falsely represent your affiliation with any person or entity; or
  • post or transmit any content that is defamatory, obscene, offensive, hateful or inflammatory.

Breach of these requirements may result in immediate termination of your access and, where appropriate, referral to law enforcement authorities.

5. Intellectual property

5.1 Our content

All content on our Websites - including text, graphics, logos, icons, images, audio clips, data compilations, software, and the selection and arrangement thereof - is owned by or licensed to E2E SC and is protected by copyright, trade mark, database rights and other intellectual property laws of England and Wales and international conventions. The E2E SC name, logo and all related marks, product names and slogans are trade marks of E2E SC. You must not use them without our prior written consent.

5.2 Permitted use of our content

You may view, download and print pages from our Websites for your own personal, non-commercial use, and share links to our pages provided you do so fairly and in a way that does not damage or take advantage of our reputation. You must not reproduce, copy, modify, adapt, translate, publish, display, distribute, sell, sub-license or create derivative works from any content on our Websites without our express prior written permission, remove or alter any proprietary notices, or use our content in any way that suggests an association with or endorsement by E2E SC that does not exist.

5.3 Your content and submissions

Where our Websites allow you to submit, post or share content (including enquiry forms, feedback or any other user-generated material), you grant E2E SC a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, modify and display that content for the purpose of operating and improving our Websites and services. You represent and warrant that: (a) you own or control all rights in the content you submit; (b) the content is accurate and not misleading; and (c) the content does not infringe any third-party rights or violate any applicable law.

5.4 IP in client deliverables

Intellectual property rights in work product, reports and deliverables produced under a signed engagement are governed by the applicable Master Services Agreement, not these Terms.

6. User-generated content

We are not responsible for the accuracy, completeness or legality of any content submitted to us by users. We reserve the right (but do not assume any obligation) to review, edit or remove any user-submitted content at our sole discretion, at any time and without notice. If you believe any content on our Websites infringes your intellectual property rights or otherwise violates these Terms, please contact us at info@e2esc.co.uk with full details. We will investigate reasonable complaints and take appropriate action.

7. Disclaimer of warranties

7.1 Websites provided 'as is'

Our Websites and all content, information and materials published on them are provided on an "as is" and "as available" basis, without any representation, warranty or guarantee of any kind, whether express, implied or statutory. To the fullest extent permitted by applicable law, E2E SC expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement; any warranty that our Websites will be uninterrupted, error-free, secure or free of harmful components; and any warranty as to the accuracy, completeness, reliability, timeliness or suitability of any content.

7.2 Marketing and promotional content

Content published for marketing, promotional or informational purposes - including case studies, service descriptions, capability statements, blog posts, whitepapers and any statistics or benchmarks - is provided for general information only. It does not constitute professional advice and should not be relied upon as such. Results described are illustrative and will vary depending on the specific circumstances of each client; past performance does not guarantee future results. Nothing on our Websites constitutes legal, regulatory, financial or cybersecurity advice; you should obtain your own independent professional advice before making any decision based on content published here.

7.3 Third-party content

Our Websites may include content sourced from or referring to third parties (including NCSC guidance, industry frameworks or external research). We do not warrant the accuracy or completeness of such content and accept no liability in respect of it. Inclusion of any third-party reference does not constitute endorsement.

8. Limitation of liability

8.1 Exclusion of loss

To the fullest extent permitted by law, E2E SC, its directors, employees, contractors and licensors shall not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising out of or in connection with: your use of, or inability to use, our Websites; any reliance placed on content published on our Websites; any interruption, suspension or withdrawal of our Websites; any data loss, corruption or breach affecting data you submit to our Websites; or any third-party content, products or services accessible from our Websites.

8.2 Types of loss excluded

We specifically exclude liability for loss of profits, revenue or business; loss of anticipated savings; loss of contracts or commercial opportunities; loss of goodwill or reputation; loss or corruption of data or information; and any indirect, special, incidental, punitive or consequential loss of any kind - whether or not E2E SC has been advised of the possibility of such losses.

8.3 Cap on liability

Where liability cannot be excluded entirely by law, our total aggregate liability to you in connection with your use of our Websites shall not exceed £500 (five hundred pounds sterling).

8.4 Exceptions - mandatory legal rights

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law, including your statutory rights as a consumer where applicable. Nothing in these Terms affects your statutory rights.

9. Third-party links and framing

9.1 Outbound links

Our Websites may contain links to third-party websites, resources and services that are not owned or controlled by E2E SC. These links are provided for your convenience only. We have no control over, and accept no responsibility for, the content, privacy practices or availability of those third-party sites. Inclusion of any link does not imply endorsement. You access third-party websites entirely at your own risk and subject to their own terms.

9.2 Linking to our websites

You may link to our homepages provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation, and that does not suggest any form of association or endorsement where none exists. We reserve the right to require you to remove any link by giving written notice, with which you must comply promptly.

9.3 Framing and embedding - prohibited

You must not frame, embed, mirror or otherwise reproduce our Websites or any part of them within another website, application or platform without our prior written consent. Framing within an iframe or equivalent, "deep-linking" that removes or obscures our header, footer, branding, navigation or legal notices, and screen-scraping or automated extraction of content for republication are prohibited.

9.4 Social media sharing

Standard social media sharing of links to publicly accessible pages on our Websites is permitted, subject to the restrictions above. Bulk automated posting, bot-driven amplification or sharing in a misleading context is not permitted.

10. Privacy and cookies

Our collection and use of personal data through our Websites is governed by our Privacy Notice. Our use of cookies is governed by our Cookies Policy. Both documents are incorporated by reference into these Terms. By using our Websites you acknowledge that we may process your personal data in accordance with our Privacy Notice. 11. Lead capture, trials and pricing

11.1 Lead capture forms

Where our Websites include forms for enquiries, newsletter sign-up, resource downloads, demo requests or other lead capture purposes, submission of such a form constitutes your consent to E2E SC contacting you for the purposes described at the point of collection. We will handle your data in accordance with our Privacy Notice. We do not sell, rent or share your contact details with third parties for their marketing purposes without your explicit consent.

11.2 Free trials

Where E2E SC offers free trials of any product or service via our Websites, use of such trials is subject to any additional trial-specific terms presented at sign-up, together with these Terms. We reserve the right to withdraw or modify trial offers at any time.

11.3 Pricing information

All pricing, fee estimates and commercial information published on our Websites are provided for indicative purposes only and do not constitute a binding offer. Actual pricing is subject to a signed Order Form or equivalent commercial agreement. All published prices are exclusive of VAT unless expressly stated otherwise. We reserve the right to change published pricing at any time without notice; pricing changes do not affect the terms of any existing signed agreement.

12. Changes to these terms

We may update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where we consider the changes significant, we may notify registered users by email or via a notice on our Websites. Your continued use of our Websites after any change constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Websites. Previous versions are available on request by emailing info@e2esc.co.uk.

13. Governing law and jurisdiction

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer resident in Scotland, Northern Ireland or another jurisdiction, you may also have the right to bring proceedings in your local courts. Nothing in this clause restricts our right to take proceedings against you in any other court of competent jurisdiction, including to seek injunctive or other interim relief.

We aim to respond to all written complaints within 10 business days. If you are not satisfied with our response, you may have rights to escalate to the relevant regulator or alternative dispute resolution scheme, details of which we will provide on request.
